§ 02 — Informativa Privacy · GDPR / D.Lgs. 196/2003

How we handle your data

Data controller. The controller of your personal data is Carlo De Marchis (see Imprint). You can reach us at carlodemarchis@gmail.com or our certified mail carlodemarchis@pec.it.

What we collect

Account data (name, email — used to recognise you as an active member of the A Guy With A Scarf premium subscription on Substack) and course-usage data (which lessons you have opened, notes, watch progress). We do not collect payment-card data, billing addresses, or invoicing details — your subscription is handled entirely inside Substack, which acts as merchant of record for the transaction.

Legal basis and purpose

We process your data to (a) deliver course access as a benefit of your active Substack premium membership [Art. 6(1)(b) GDPR], (b) provide account support you request [Art. 6(1)(b)]. Subscription billing, invoicing, and payment data are processed by Substack and Stripe under their own privacy policies. We do not process your data for marketing unless you actively subscribe to the newsletter, in which case the basis is consent [Art. 6(1)(a)], revocable at any time.

Retention

Account data: for as long as you hold an account, plus 12 months after closure for support continuity. Invoicing and transaction data: 10 years (Italian civil and tax law, Art. 2220 c.c. and D.P.R. 600/1973). Newsletter data: until you unsubscribe. Logs: 90 days.

Data processors

We rely on a small set of named processors, each bound by a Data Processing Agreement under Art. 28 GDPR:

Subscription billing (merchant of record), newsletter delivery, payment processing via Stripe. Processes email, billing, payment, and engagement data. US. Privacy: substack.com/privacy.
Supabase, Inc.
Auth, database, storage. Processes account and course-usage data. EU region (Zurich, Switzerland). Privacy: supabase.com/privacy.
Bunny.net (BunnyWay d.o.o.)
Video and PDF delivery (CDN). Processes IP and basic request logs. EU (Slovenia). Privacy: bunny.net/privacy.
Railway Corp.
Application hosting. Processes server logs. EU region (europe-west4). Privacy: railway.com/legal/privacy.
Sendinblue SAS (Brevo)
Transactional email delivery — sign-in magic links and welcome emails. Processes the recipient's email address and message content. EU (France). Privacy: brevo.com/legal/privacypolicy.

Transfers outside the EEA

Where a processor is located outside the EEA (Railway, Substack), the transfer is governed by the European Commission's Standard Contractual Clauses (SCCs) and supplementary measures. Details available on request.

Your rights

You have the right to access, rectify, erase, port, restrict or object to the processing of your personal data (Arts. 15–22 GDPR). Write to us at carlodemarchis@gmail.com and we will respond within 30 days. You may also file a complaint with the Italian Garante per la protezione dei dati personali — garanteprivacy.it.

What we store in your browser

We use only technical cookies strictly necessary to run the site. No consent banner is legally required for these, because they are not profiling or tracking tools. No analytics, advertising, or third-party tracking cookies are set.

Course-state keys (current lesson, order draft). Not transmitted to the server; cleared when you log out.

If we later add an analytics or marketing tool, a cookie banner with Accept / Reject / Customize will appear before any non-essential cookie is set, and this policy will be updated accordingly.

§ 04 — Course access terms

Terms of access

1. Provider

2. What you're accessing

This site delivers a self-paced digital course, Becoming a Better B2B Tech Vendor in Sports and Media, with twelve pre-recorded lessons, downloadable PDF slides, audio-only tracks, and a digital companion book (PDF). Access is granted as a benefit of an active premium membership purchased on Substack — see §3 below.

3. Subscription and merchant of record

The premium membership that includes course access is sold by Substack Inc. as merchant of record, via their billing infrastructure (Stripe). Substack's Terms of Use and Privacy Policy govern the subscription itself: pricing, payment, VAT collection, invoicing, refunds and cancellation. Carlo De Marchis is the content provider but is not the seller of the subscription. Course access on this site is granted for the duration of your first paid year on Substack and becomes a permanent benefit of your account once that year is complete; the digital companion book is a downloadable PDF that becomes yours unconditionally once retrieved.

4. How access is granted

Once your subscription is confirmed by Substack, Carlo De Marchis grants access on this site and emails you a welcome message containing a one-time sign-in link. From that point you can sign in at any time using the same email address. There is no separate account creation step.

5. Conformity of digital content

Digital content delivered to consumers is covered by the statutory conformity guarantee of D.Lgs. 170/2021 (two years from delivery). If a lesson fails to play, a file is corrupted, or your access is incorrectly revoked, write to us at carlodemarchis@gmail.com and we will repair, re-issue, or restore access within a reasonable time at no cost.

6. Complaints and disputes

For issues related to subscription billing, refunds, or cancellation, contact Substack directly via their support channels. For issues related to the course content or this site, write to carlodemarchis@gmail.com. If we cannot reach an agreement, consumers resident in the EU can use the European Commission's online dispute-resolution platform: ec.europa.eu/consumers/odr.

7. Applicable law and jurisdiction

Italian law applies to the content-provision relationship between Carlo De Marchis and you. For consumers, the competent court is the one of the consumer's place of residence. For B2B disputes, the court of Torino has exclusive jurisdiction. The subscription contract itself is governed by Substack's terms.

§ 05 — Cancellation & statutory rights

Cancellation & statutory rights

Because the premium membership is sold by Substack as merchant of record, the contract for the subscription itself is between you and Substack. Cancellation, refund, and the EU 14-day right of withdrawal under Art. 52 D.Lgs. 21/2014 are governed by Substack's terms — see substack.com/refund-policy and Substack support for the cancellation procedure that applies to your country and tier.

What happens on this site when you cancel

On Substack annual subscriptions, "cancel" means stopping the next renewal — it does not end your current paid period. You retain full access to the course, the digital companion book, the newsletter and the premium archive for the 12 months you paid for. At the end of that period, you become a free subscriber on Substack; on this site, the course and the digital companion book remain in your account permanently, regardless of whether you renew. The only window where access can be reversed earlier is Substack's automatic refund within 7 days of payment: in that case the subscription is cancelled and course access on this site is revoked accordingly. The digital companion book, once downloaded, is yours independent of any subscription state.

Content-side issues

For problems with the content itself — a lesson that fails to play, a corrupted file, or access that doesn't arrive after a confirmed subscription — contact carlodemarchis@gmail.com. The statutory conformity guarantee under D.Lgs. 170/2021 (two years from delivery) covers the digital content provided by Carlo De Marchis.
